The Commercial / Contracts Manager will be responsible for all commercial and contractual aspects of the Company's mandate to provide Project Management / Control services to its Client.

The Commercial / Contracts Manager shall report directly to the Senior Project Director and shall liaise with the Client's representative and Legal Advisor on a regular basis.

The Commercial / Contracts Manager will lead the contract administration team comprising of quantity surveyors, planning engineers and document controllers.

This position pertains to the management of three commercial / residential tower projects in the Island of Abu Dhabi.

Duties and Responsibilities

General

• Review, develop and implement contract administration procedures, systems and policies in consultation with the Senior Project Director.
• Advise and assist the Senior Project Director and Client's Representative and Legal Advisor on all commercial and contractual matters.
• Provide the necessary guidance to members of the contract administration team on contractual and commercial issues.
• Provide the necessary inputs to the monthly report as well as prepare all other reports dealing with commercial and contractual issues.
• Assimilate the monthly progress reports and advise the Senior Project Director of any possible contractual implications.
• Attend project meetings where necessary and provide advice on commercial and contractual issues.
• Assist the Project Control Manager / Planning Manager in providing the necessary Risk Management services.
• Document previous and future lessons learnt and ensure that the appropriate feedback is conveyed to, and applied by the relevant stakeholders.

Tenders:

• Gather the necessary information from the Client and if necessary, liaise with the Design Consultants, to:
- Prepare RFPs and tender documents.
- Address all queries with regards to RFPs / Tenders.
- Prepare tender evaluation reports and recommendations.
• Prepare, review, clarify and address queries on contractual correspondence including consultancy agreements, draft contract documentation (such as letters of intent), tender documentation, etc.
• Pre-qualify Consultants and Contractors.
• Review and comment on tender analysis prepared by project stakeholders before it is presented to the Client.
• Check contract documentation and negotiate contract terms to the best interest of the Client with particular attention to managing future risk.

Claims and Disputes:

• Manage claims and their associated correspondence and documentation.
• Identify possible areas of dispute amongst the Consultant(s) and Contractor(s) and take the necessary proactive measures.
• Review insurance claims arising on the project and assist the Client to successfully conclude such claims.
• Agree final accounts, including the assessing and resolution of commercial claims.

Cost Control:

• Review and verify existing budgets and cost management plans prepared by the Client.
• Prepare a budget and cost management plan and updates thereof as necessary for approval by the Client.
• Work with the planning engineering to forecast and monitor cash flow.
• Facilitate and participate in value engineering exercises if necessary.

Administrative:

Work with the contract administration team to:

• Maintain and update logs for contracts, payments and site instructions / change orders.
• Coordinate release of design and construction documents in a timely manner.
• Ensure that the necessary / updated design or construction documents are in the possession of the relevant parties.
• Ensure that contractual correspondence is prepared, issued and responded to in a timely manner.
• Prepare and issue payment certificates and interim valuations in a timely manner.
• Issue and agree instructions to contractors in a timely manner and in accordance with the change management procedures.
